Arbitration
Arbitration is an alternative method of dispute resolution that occurs when parties select a neutral third party, called the arbitrator, to resolve a dispute outside of the courts. The arbitrator’s decision, also called an Award, is final and binding, unless otherwise agreed by the parties.
Choosing arbitration to resolve a dispute can have many advantages. Not only is arbitration generally less expensive and time consuming than litigation, but through active participation in the resolution process you can create a solution that is mutually beneficial to everyone involved. Through the arbitral process, parties can agree to keep sensitive information and the final resolution confidential.
While both arbitration and mediation are forms of alternative dispute resolution, a mediator helps to facilitate the resolution of a dispute, while an arbitrator is appointed to make a final decision that is binding. To learn more about mediation click here
